The claim that Trump declassified the documents he took to Mar-a-Lago has never been backed by any record, and Trump's own lawyers did not make it in court.
The claim
After the FBI recovered classified documents in August 2022, Trump said he had declassified them, and later that a president can declassify "even by thinking about it."
What the evidence shows
- No records. No declassification orders or notices covering the documents have been produced
- In court. Trump's lawyers did not tell the courts that the documents had been declassified, despite opportunities to do so
- His own words. The 2023 federal indictment quotes a 2021 recording in which Trump showed a document and said that as president he could have declassified it, "Now I can't"
- The case. The classified-documents prosecution was dismissed in July 2024 on the ground that the special counsel's appointment was unlawful. It never reached a ruling on declassification
Why it matters
The declassification claim was the main public defense for keeping national-security records at a private club.
