While serving as secretary of state from 2009 to 2013, Hillary Clinton used a private email server for official business. As the issue grew in 2015, she repeatedly said she had not sent or received any material marked classified. In July 2016, FBI Director James Comey said investigators found classified information in more than 100 emails, and that a very small number bore classification markings.
The claim
Clinton's defense rested on the word "marked": she argued that classified documents carry clear headers and that none of her emails did.
What the evidence shows
- Classified content. Comey said 110 emails in 52 chains contained information that was classified at the time it was sent.
- A few markings. He said a very small number carried markings indicating classified information. The FBI later said three emails contained a "(C)" portion marking for confidential material, without the headers that normally appear on classified documents.
- Possible mislabeling. The State Department said at least two of those were call-sheet drafts that had been marked by mistake.
- No charges. The FBI recommended against prosecution, describing Clinton and her staff as "extremely careless" but finding no intent to violate the law.
Why it matters
A statement can be technically defensible and still mislead. Clinton's wording invited readers to conclude that no classified information was involved, which was not the case.
