The claim that undocumented immigrants get free federal benefits is widespread but largely false. Since the 1996 welfare reform law, undocumented immigrants have been barred from almost all federal public benefits, including food stamps (SNAP), non-emergency Medicaid, Social Security and most housing assistance.
The claim
Posts often describe immigrants receiving monthly checks, free housing or government debit cards.
What the evidence shows
- Barred by law. The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 excludes undocumented immigrants from federal public benefits.
- Narrow exceptions. Emergency medical care is available to everyone under federal law, and children have a right to public K–12 education under Plyler v. Doe (1982).
- Citizen children. US-born children of undocumented parents are citizens and may qualify for benefits in their own right, which is sometimes misreported as benefits for their parents.
- Local programs. Some states and cities fund limited programs, such as shelter, with their own money.
Why it persists
Local emergency spending and benefits for citizen children are often mixed up with federal welfare.
