The claim that Mueller's team was a partisan operation that rigged the Russia investigation relies on a real fact, that several lawyers had given to Democrats, and an unproven conclusion about how they behaved.

What the evidence shows

  • Mueller's own record. Robert Mueller is a lifelong Republican who was appointed FBI director by President George W. Bush and kept on by President Obama. Deputy Attorney General Rod Rosenstein, a Trump appointee, named him special counsel on May 17, 2017.
  • Staff donations were real. Federal Election Commission records reported in 2017 showed that several members of his legal team had donated to Democratic candidates. Critics saw an appearance problem. Defenders said political donations alone do not disqualify career lawyers.
  • One real removal. FBI agent Peter Strzok was removed from the team in July 2017 after the discovery of anti-Trump text messages. That is evidence the office acted on bias concerns.
  • The results cut both ways. The report did not establish a conspiracy, a finding that benefited Trump, and it also detailed episodes of potential obstruction that did not. A rigged inquiry would be unlikely to produce a mixed result.
  • Conflict claims were examined. Trump advisers raised other alleged conflicts, such as a dispute over golf club fees. The Mueller report indicates advisers told Trump they were not serious.

Why it persists

Donations are public and the allegation is easy to state. It also served as a general explanation for any unfavorable finding.

Lessons for readers

  • Test a claim of bias against the results, not only the résumés.
  • An appearance problem is real and also not proof of misconduct.
